City Fresh Market Pleads Guilty to Violating One Count of the Food and Drugs Act

On February 22, 2011, in British Columbia Provincial Court, 1077223 Alberta Ltd., also known as City Fresh Market, pled guilty to one count of violating the Food and Drugs Act.

The Honourable Judge McKinnon imposed a fine of $2,500.00, payable within 30 days against the Richmond-based company.

A Canadian Food Inspection Agency (CFIA) investigation determined that the company was unlawfully selling a food product, specifically canned dace, which was adulterated with Enrofloxacin. This action violated Section 4(1)(d) of the Food and Drugs Act. Enrofloxacin is a veterinary drug that is approved for use by Health Canada but not in aquacultured fish.

The CFIA enforces federal legislation, including the Food and Drugs Act and its Regulations. The CFIA safeguards food, animals and plants, which enhances the health and well-being of Canada's people, environment and economy, and access to international markets.
